4. GameMonetize Content Notice
Crictadka.com features games provided by GameMonetize, a third-party gaming platform. We embed these games through their API and do not directly host game files. When we receive a valid DMCA notice regarding game content, we will:
- Promptly investigate the claim
- Temporarily disable access to the allegedly infringing game
- Notify GameMonetize of the infringement claim
- Cooperate with GameMonetize to resolve the issue
Game developers who have issues with their games being displayed on our platform should also contact GameMonetize directly at their designated copyright agent.
5. Counter-Notification Procedure
If you believe that material you posted on or through our website was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us by providing the following information in writing:
A. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled.
B. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
C. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you reside outside the United States, for any judicial district in which we may be found), and that you will accept service of process from the person who provided notification under DMCA 512 subsection (c)(1)(c) or an agent of such person.
D. Your physical or electronic signature.
Upon receipt of a valid counter-notification, we will forward it to the complaining party. If the complaining party does not notify us that they have filed an action seeking a court order to restrain you from engaging in infringing activity relating to the material on our website within 10 business days, we may replace or cease disabling access to the material.
6. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also at our sole discretion limit access to our website and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
